Many of my clients who receive Reckless Driving or Speeding tickets in Virginia often find themselves facing another charge for possessing a radar detector. Although there are many signs warning drivers as you enter Virginia, most of my clients simply forget to turn the device off.  Virginia Law states the device cannot have a power source and cannot be accessible by the driver.  Therefore, you can be convicted under this code section even if your radar detector was not in operation at the time.  The prosecutor will only have to prove that you had access to it and there was a power source.  Although there are no points added to your driving record when convicted of possessing a radar detector, there is still a fine. My recommendation to my clients is to always keep the device in the trunk of their car when driving in Virginia or any state where they are illegal.
